Validation agreements: towards a broader territorial coverage for European patents?

The “validation on request” agreements between the European Patent Office and non-member states, such as Morocco, Moldova and Tunisia, are not yet well known. In this article (available in English and Japanese), Kazuya Sekiguchi and Martin Chatel shed light on the possible benefits for European patent applicants seeking to protect their innovation beyond the European market.

はじめに

2015年初めにブノア・バティステリ欧州特許庁(EPO)長官は「大陸図の領域を超えて考慮する」と発言し、今後のビジョンを明確にした 。 欧州における特許制度を強化するための優先事項は、統一特許制度の最終的な 詳細策定に限定されず、グローバルな特許制度における作業の重複排除、ワークシェアリングの向上、規則の調和などに関して、依然としてなすべきことが多く残っている。
これに関連して、欧州特許庁(EPO)と欧州特許機構の非加盟国との間で新しい枠組みが出来はじめている。EPOが、いわゆる「バリデーションに関する協定(バリデーション協定)」と呼ばれる、現在の欧州特許条約(EPC)においてカバーされる40カ国(締約国38、拡張国2)を更に拡大する協定を制定したのである。係る協定は欧州特許条約への加盟を強制するものではなく、よって欧州諸国に限定されるものではない。
現在までに、6か国がこのバリデーション協定に加盟または加盟を検討しており、バリデーション協定 はすでにモロッコ(2015年3月1日)⑴とモルドバ(2015年11月1日)⑵において発効している。当該バリデーション協定により、EPOにより付与された特許がカバーする国の範囲は東欧諸国国および地中海諸国を超え、カンボジアとラオス人民民主共和国にまで広げられ得る。2017年5月にはEPOとアンゴラが交渉を開始する同意をしている。また、カンボジアおよびチュニジアとEPOの間でもバリデーション協定が近々発効する可能性があり、これに追従する国がさらに出てくると考えられる。したがって、今後係る協定の利用が出願人にとって費用対効果の面で有利で戦略的な出願の選択肢となる、つまり通常ルートの出願に取って代わる権利化手段として利用価値が上がっていくことが予想される。

Validation agreements: a game changer for European patent applicants?

Patent backlog is a major problem for many patent offices. In order to meet growing needs for predictable, cheaper and faster filing and examination procedures, much remains to be done in terms of reducing duplication of work and harmonising practices. The “validation on request agreements” between the European Patent Office and non-contracting member states may offer a cost effective and streamlined option for European patent applicants seeking protection in multiple countries simultaneously.
